Silent Music Band Co, Ltd (¡°SMB¡±, "we", "us", or "our") values all personal information submitted by users during membership registration and service usage. All personal information provided to SMB will only be used to provide our services. We are committed to protecting your privacy, and we will not share your personal information with third parties without your approval. SMB complies with several privacy protection guidelines established by the Ministry of Information and Communication, the article on Protection of Communication Secrecy of the Telecommunications Business Act, the Act on Promotion of Utilization of Information and Communications Network, and the Personal Information Protection Guidelines. SMB's privacy policy explains our privacy practices to inform the member about the uses and methods of use of private information. Our web site provides a link to the privacy guidelines so that our members can have easy access to this information. SMB's privacy policy may be revised from time to time; the changes will be posted on the home page along with the date of the change and other relevant information so members can conveniently access the information. Agreement on collecting personal information During membership registration, when you click on the button labeled ¡°I agree¡± on the terms of use for musicshake.com, SMB regards this as an agreement to the collection of your personal information. 2. Use of personal information The term ¡°Personal Information¡± means personally identifiable information such as your name, address, phone number, email address etc¡¦ Even though a single piece of information may not uniquely identify you, when combined with additional information, they will be able to confirm your distinct identity. Most of SMB¡¯s services can be used without registering as a user. However, in order to provide customized services and higher quality services, we may collect additional information. This is only performed under your consent and you have the option to reject our request for more information. We do not share the information collected from you without your prior approval. The collected information is used in the following ways: 1) SMB can develop more useful services based on personal information provided during membership registration. We can efficiently prioritize the development of new services and contents by basing our decisions on information collected from the users. Furthermore, we can choose and provide the most appropriate content for each user. 2) All the information and services provided by SMB is free. We may place advertisements in order to provide this free service. Based on the member¡¯s personal information, we can place the appropriate ads and contents to each service or menu. This can be an introduction to a product that the member may want or need, resulting in another informative service by SMB. SMB will be receiving the ads from the advertisers; the appropriate ads will be shown to the members whose profiles match the target profiles from the ads. We will not expose any member information to the advertisers without the agreement of the member. 3. Collection of personal information and method of collection During membership registration SMB requires the minimal personal information necessary to establish a legal and fair service contract. In some occasions such as promotions and surveys, we may ask for some personal information in order to provide gifts or to calculate statistics. In such cases, we will not collect sensitive information that may infringe upon your privacy (nationality, race, religion, political views, criminal record, health status, sexuality etc¡¦). If we cannot avoid the collection of such information, we will ask for your prior approval. All information we collect will only be used for the stated purpose and we will not disclose this to individuals or companies outside of SMB. We may also collect some information that identifies you personally for the external advertisers and web sites linked within our pages. 4. Period of retention and use of personal information As long as you are an SMB member using the services that SMB provides, your personal information will be kept and used for the provision of service. However, if you delete, modify, or cancel your membership, we permanently delete (or modify) your information from our hard disks. This process is irreversible, and you will not be able to view or use your old information. We reserve the right to terminate the membership regardless of the member¡¯s will for some users who violate SMB¡¯s terms of use and public morals, resulting in the disturbance of service or the damage to other members. In this case, the personal information will also be deleted permanently. 5. Sharing of personal information SMB uses the collected personal information as stated in section 2 (¡°use of personal information¡±) in our privacy policy and we do not disclose this information outside without the previous agreement by the member. The following cases are the exceptions. 1) Users agreed previously to the disclosure. 2) A fee needs to be calculated according to service usage. 3) The member violated the terms of use or other policies stated on our web pages. 4) There is enough evidence to determine the need for legal actions due to a member causing mental and material damage to others. 5) The information is needed for legal and/or regulatory purposes (for example, complying with the requests from legal procedures in a government investigation). 6) Providing information to an academic study, market survey, or statistical research; the disclosed information does not identify a specific person to the advertiser, cooperative enterprise, or research center receiving the information from us. 7) For new services or events where member information is shared, members are notified by email or by phone. In such cases, we will disclose the individual, organization, or group which will be using our member's information (along with the purpose for sharing information, duration of use, third party's privacy policies) and we will ask for our member's approval. Without the consent of our members, we will not collect or share extra information. When we post ads specifically targeted towards a gender or an age group, we will not disclose any personal information to the advertiser; if any information is necessary for an academic study, market survey, or statistical research, the disclosed information will not identify a specific person. 6. Management of personal information (review, update, and delete) Members can view and modify their personal information by going into the SMB home page. Members may also request a cancellation of membership. In order to view and modify personal information, you must login to the membership administration page with your user ID and password. All information except the user ID and your name may be modified. In case you lose your password, there is a link below the login menu which guides the user through a password recovery process where we first verify the identity and then email the password to the email address of the member. In order to cancel your membership, you must login to the membership administration page with your user ID and password then go through some verification processes based on the information provided during membership registration before proceeding onto cancellation. 7. Use of cookies To provide a more customized service for our members, SMB uses cookies which are used to store and retrieve member information. A cookie is a small file (text) that the web server (HTTP) places in the user's browser; it is often stored in the hard drive of the user. In order to use the membership services and some other services, you must allow the use of cookies. To provide a more appropriate and useful service, we use cookies to find the most relevant information about the user ID. We use cookies to find the SMB services you have used and the web pages you have visited. By understanding the patterns of use, search keywords, and scale of use, we are able to provide a more personalized service with the most optimized content for each member. You are able to accept or decline the use of cookies. Web browser options may be set to allow all cookies, verify each cookie being stored in your computer, or decline the use of all cookies. If you choose to decline the use of cookies, you will have not access to some features in SMB which require user login. 8. Technical and administrative measures to prevent unauthorized access, use, or disclosure of personal information SMB has the following technical measures for the security and safety of your personal information from loss, theft, leakage, alteration, and damage: 1) Your personal info is protected thoroughly by your password. Only you know your ID and password to the SMB site and only you can confirm and change your personal information. Do not share your password with anyone. Also, we encourage you to log-out when you have finished using SMB services, and also close the web browser. Take special care to follow the (afore mentioned) safety guide lines in order to protect your personal information when you are sharing your computer with others or if you are accessing the SMB sites from public places (company, school, library and PC room, etc...). 2) To prevent the leakage or alteration of personal information from To prevent the leakage or alteration of personal information as a result of hacking and viruses, we use the latest vaccine programs to protect against viruses. We also use an access control system to stop any unauthorized intrusions from the outside. We apply our technical expertise to maintain stability throughout our systems. 3) We are limiting the number of our personnel assigned to securing the privacy of our users. We also assign a special revolving password that gets changed periodically for the person in this role. We also ensure that the person in charge gets trained on a regular basis to enforce a strict adherence to our privacy policy. 9. Consignment of personal information SMB can consign the processing of your personal information to an external company for the improvement of service. When your personal information is consigned, we will notify our members before hand. The terms and conditions of the consignment, including the adherence to privacy policy, confidentiality agreements, forbidding information sharing with third parties, accountability in case of accidents, etc..., will be clearly defined. The terms of the contract will documented either on paper or on an electronic document. 10. Children's personal information Children of age 14 and under must properly understand the purpose and usage of collecting personal information and they must receive the consent of their legal guardians. Thus when children of age 14 and under register on SMB, we will verify their legal guardian¡¯s approval for them to register. The legal guardians may view, update, and cancel registration of their children and when such requests are made; we will not hesitate to fulfill the request. 11.
